Passport law of the People 's Republic of China

Article 1 This Law is formulated in order to standardize the application, issue and management of the passports of the People 's Republic of China to protect the rights and interests of citizens of the People' s Republic of China from entering and leaving the territory of the People 's Republic of China and promoting foreign exchanges.


Article 2 The passport of the People's Republic of China is a document of citizens of the People's Republic of China who have entered and surpassed the country and certifying their nationality and identity abroad.

No organization or individual may forge, alter, transfer, intentionally destroy or illegally detain a passport.


The third passport is divided into ordinary passport, diplomatic passport and official passport.

Passport is promoted by the Ministry of Foreign Affairs to foreign governments through diplomatic channels.


Article 4 An ordinary passport shall be issued by the entry and exit administrative organ of the public security organ of the local people's government at or above the county level and the other embassies and consulates of the People's Republic of China and other foreign institutions entrusted by the Ministry of Foreign Affairs under the entrustment administrative organ of the Ministry of Public Security or the Ministry of Public Security.

The diplomatic passport is issued by the Ministry of Foreign Affairs.

The official passport shall be issued by the Ministry of Foreign Affairs, the embassies or consulates of the People's Republic of China, the other foreign institutions entrusted by the Ministry of Foreign Affairs and the foreign affairs departments of the people's governments of provinces, autonomous regions, municipalities directly under the Central Government and districts designated by the Ministry of Foreign Affairs.


Article 5 Citizens who apply for ordinary passports by the entry and exit administrative organs of the public security organs of the local people's governments at or above the county level where they go to the place of residence shall go to the country where they go abroad for their reasons of traveling abroad, such as going abroad, visiting relatives, studying, employment, traveling, engaging in business activities and other non-official reasons.


Article 6 When applying for an ordinary passport, the citizen shall submit his / her resident identity card, residence booklet, recent photo of the hatcher and the relevant materials for the application. Where a national staff member applies for an ordinary passport for the reasons prescribed in Article 5 of this Law, it shall submit the relevant supporting documents in accordance with the relevant provisions of the State.

The entry and exit administrative organ of the public security organ shall issue an ordinary passport within 15 days from the date of receipt of the application materials. If the non-compliance is not issued, it shall give a written explanation of the reasons and inform the applicant of the application for administrative reconsideration or administrative action right.

In remote areas or areas with inconvenient transportation or due to special circumstances, can not be issued on time passport, passport issued by the person in charge of approval, the time can be extended to 30 days.

If the citizen requests for expedited emergency due to reasonable urgency, the entry and exit administrative organ of the public security organ shall handle it in time.


Article 7 The registration items of ordinary passports include the name of the passport holder, the date of birth, the place of birth, the date of issue of the passport, the period of validity, the place of issue and the issuing authority.

Ordinary passport valid for: passport holders under sixteen years of age five years, more than sixteen years of age.

The specific way of issuing ordinary passports is prescribed by the Ministry of Public Security.


Article 8 Diplomatic officers, consular officers and their accompanying spouses, minor children and diplomatic couriers hold diplomatic passports.

In the People's Republic of China embassies, consulates or the United Nations, the United Nations specialized agencies and other international intergovernmental organizations in the work of the Chinese government and its accompanying spouses, minor children holding official passport.

Where a citizen other than the preceding two regulations is going abroad for business purposes, his / her work unit shall apply to the diplomatic department in accordance with the provisions of Paragraph 2 and Paragraph 3 of this Law, and the diplomatic department shall issue a diplomatic passport or official passport as necessary.


Article 9 The registration items of diplomatic passports and official passports shall include the name of the passport holder, the date of birth, the date of birth, the date of birth of the passport, the date of validity of the passport, the date of validity of the passport and the issuing authority.

Diplomatic passports, official passports issued by the scope of the issue, the validity of the official passport and the specific category, by the Ministry of Foreign Affairs.


Article 10 When the registration of a passport held by a passport holder is changed, the relevant supporting documents shall be submitted to the passport issuing authority for the change of the passport.


Article 11 In any of the following circumstances, the passport holder may apply for renewal or renewal of the passport as required:

(A) the validity period of the passport is about to expire;

(B) the passport visa page is about to be used;

(C) passport damage can not be used;

(4) the passport is lost or stolen;

(5) other circumstances where there is a legitimate reason for the need to renew or renew the passport.

Passport holders apply for renewal or replacement of ordinary passports, in the country, by the person to the place of residence at the county level above the local people's government public security organs immigration authorities; abroad, by the People's Republic of China Embassy, Or other foreign agencies commissioned by the Ministry of Foreign Affairs. If a Chinese citizen who resides abroad is required to apply for renewal or replacement of an ordinary passport, he shall submit it to the immigration administrative organ of the public security organ of the local people's government at or above the county level.

Diplomatic passport, official passport renewal or replacement, in accordance with the relevant provisions of the Ministry of Foreign Affairs.

Article 13 If the applicant has any of the following circumstances, the passport issuing authority shall not issue a passport:

(1) having no nationality of the People's Republic of China;

(2) unable to prove identity;

(3) fraudulent in the application process;

(D) being sentenced to sentence is serving a sentence;

(5) the people 's court has notified that there is an unqualified civil case that can not leave the country;

(6) a defendant or a criminal suspect who is a criminal case;

(7) The relevant competent department of the State Council considers that after leaving the country, it will cause harm to the national security or cause significant losses to the national interests.


Article 14 If one of the following circumstances is made by the applicant, the passport issuing authority shall not issue a passport within six months to three years from the date of execution of the penalty or the date of repatriation:

(1) being subject to criminal penalties for obstructing the country (border);

(2) illegally residing and returning illegally for repatriation.


Article 15 The people's courts, the people's procuratorates, the public security organs, the state security organs and the administrative supervision organs may seize the passports of the parties to the case according to their needs.

If the party concerned refuses to surrender the passport, the state organ provided for in the preceding paragraph may draw the passport issuing authority to declare the passport of the party concerned.


Article 16 If the holder of a passport loses the nationality of the People's Republic of China, or if the passport is lost or stolen, the passport issuing authority shall declare the passport.

Forged, altered, defrauded or issued by the issuing authority to invalidate the passport.


Article 17 Whoever falsifies a passport by fraudulent passport shall be confiscated by the passport issuing organ or declared that the passport shall be invalidated; the public security organ shall be fined not less than 2,000 yuan but not more than 5,000 yuan; if a crime is committed, criminal responsibility shall be investigated according to law.


Article 18 Whoever provides a forged or altered passport for others or sells a passport shall be investigated for criminal responsibility according to law. If the criminal punishment is not enough, the public security organ shall confiscate the illegal income and shall be detained for less than ten days but not more than 15 days More than 1,000 yuan a fine of 5,000 yuan; illegal passport and its printing equipment collected by the public security organs.


Article 19 Whoever engages in forged or altered passports or impersonates a passport of a foreigner's passport shall be punished by the public security organ in accordance with the law of entry and exit administration; and the illegal passport shall be collected by the public security organ.


Article 20 If a staff member of a passport issuing authority has any of the following acts in the process of handling a passport, he shall be given an administrative sanction according to law; if a crime is constituted, he shall be investigated for criminal responsibility according to law:

(A) should be accepted and inadmissible;

(B) without a valid reason not issued within the statutory time limit;

(3) the fees charged beyond the national standard;

(4) to obtain or accept bribes from the applicant;

(5) to disclose the personal information of citizens who have been informed of the production of passports and infringed upon the lawful rights and interests of citizens;

(6) other acts of abuse of power, neglect of duty, favoritism.


Article 21 An ordinary passport shall be prescribed and prescribed by the Ministry of Public Security. The diplomatic passport and official passport shall be prescribed by the Ministry of Foreign Affairs.


Article 22 The passport issuing authority may collect the fee for the passport and the fee for the passport. The fees and fees charged are paid to the treasury.

The standard of the fee and the fee for the passport shall be promulgated by the price administrative department of the State Council in conjunction with the financial department of the State Council.


Article 23 A citizen who is abroad for short-term abroad shall apply for the travel of the People's Republic of China to the embassies or consulates of the People's Republic of China or other foreign organizations entrusted by the Ministry of Foreign Affairs in cases where the passport is lost, stolen or damaged can not be used abroad The


Article 24 Citizens who engage in border trade, border tourism services or participate in border tourism shall apply to the entry and exit administrative organs of the public security organs of the local people's governments at or above the county level entrusted to the Ministry of Public Security for the entry and exit permits of the People's Republic of China.


Article 25 Where a citizen engages in the territory of a seafarer and engages in work on a foreign ship, he shall apply to the maritime administrative organ entrusted by the Ministry of Communications for the seafarer's license of the People's Republic of China.


Article 26 This Law shall enter into force as of January 1, 2007. Passports issued before the implementation of this Act will remain valid for the duration of validity. (Finish)
